Our policies
Timelines, revisions, cancellation, confidentiality, and data protection: all clear, simple, and in writing.

These policies apply to any order placed with Félix Dumont, doing business as “Cocktail Média” (“Cocktail”), a business registered under Quebec enterprise number (NEQ) 2280428162, with a business address at 1001 Rang Saint-Malo, Trois-Rivières, Quebec G8V 1X4, Canada. By confirming an order, you accept these policies in full.
Most services are delivered within 3 to 5 business days after we receive all of your final content (text, photos, information).
These timelines are estimates and may vary depending on our current workload. They only start once all required content has been sent to us.
An express delivery option is available for an extra fee, from $20 to $100 depending on urgency and service.
Every service includes one round of revisions to adjust the deliverable based on your feedback, as long as that feedback stays within the originally agreed mandate.
Any request that goes beyond that mandate, such as a change in creative direction, orientation, or scope, is a new mandate billed separately.
Revision requests must be submitted within 14 days of delivery. After that, the deliverable is considered accepted.
Extra revisions can be added for $10 to $30 each.
You may cancel an order at no charge, by written notice, as long as production has not started.
Once work has begun, any deposit paid is non-refundable. Work already completed is billed on a pro-rata basis, based on a reasonable assessment of the time and resources Cocktail had committed at the time of cancellation.
If the final deliverable does not match the mandate agreed to in writing (quote, brief, or order description), we will correct the work at no charge.
A full or partial refund may be offered if no satisfactory solution can be found, at Cocktail's discretion.
This guarantee does not apply to purely subjective or aesthetic dissatisfaction when the deliverable meets the agreed mandate.
Subject to full payment of the order, Cocktail grants you a commercial, exclusive, and permanent usage licence for the final deliverables (photos, videos, visuals, websites) produced for you, for your own business purposes.
Third-party licensed elements included in the deliverable (fonts, music, stock images, templates, etc.) remain governed by their own licence terms. They cannot be extracted or reused separately from the deliverable.
Cocktail retains the right to display deliverables in its portfolio and promotional communications, unless a written confidentiality agreement states otherwise.
The creators' moral rights, which cannot be transferred under Canadian law, remain with them. Their exercise is nonetheless limited to the extent permitted by law, to allow normal use of the deliverable.
The price shown is the final price, taxes extra, payable in Canadian dollars.
Payment is required upon order confirmation, before production begins, using the methods shown on the invoice.
Any balance unpaid past its due date bears interest at 18% per year (1.5% per month). Cocktail may suspend work in progress until payment is received in full.
Depending on the service requested, we collect: your contact information (name, email, phone), files related to your project (text, photos, videos you send us), and browsing data on our site (see the Cookies section below).
This information is used solely to carry out the agreed mandate, communicate with you, bill for our services, and improve our website.
Only the Cocktail team has access to your information. We rely on certain technology providers to deliver our services, for example web hosting, an online payment platform, and file transfer and storage tools. Before sharing personal information with a provider located outside Quebec, we carry out a privacy factor assessment to make sure it will receive adequate protection.
Files and information related to a project are kept for 1 year after the mandate ends, then destroyed or anonymized. Accounting documents (invoices, receipts) are kept longer, in accordance with our legal tax obligations.
Your information and files are never sold or shared with third parties for commercial purposes. They are stored securely, with restricted access, and deleted upon request. In the event of a privacy incident presenting a risk of serious harm, we notify the individuals concerned as well as the Commission d'accès à l'information du Québec, in accordance with Quebec's Act respecting the protection of personal information in the private sector (Law 25).

In accordance with Law 25, you have the following rights over your personal information at all times.
You can access the personal information we hold about you.
You can have inaccurate, incomplete, or outdated information corrected.
You can withdraw your consent to the collection or use of your information, at any time.
You can request the deletion of your information, subject to our legal retention obligations.
You can obtain a copy of your computerized information in a structured, commonly used format, for yourself or for a third party of your choice.

If you believe your rights have not been respected, you may file a complaint with the Commission d'accès à l'information du Québec.

Cocktail's total liability to you, for any cause whatsoever, is limited to the amount paid for the order in question. Cocktail is not liable for indirect, incidental, or consequential damages, such as lost profits or lost business opportunities.
Cocktail is not liable for delays or failures caused by circumstances beyond its reasonable control, such as a major technical outage, a natural disaster, or a strike.
These policies may be updated at any time. The last-updated date is shown at the top of the page. For orders already in progress, the version in effect when the order was confirmed applies.
These policies are governed by the laws of the province of Quebec and the applicable federal laws of Canada. Any dispute will be submitted to the courts of the judicial district of Cocktail's head office.
If any provision of these policies is found to be invalid or unenforceable, the remaining provisions remain in effect.
